Passed in 2023, this legislation (EMBAG) is an improvement in Europe toward open-source software (OSS) in the public sector.

Under EMBAG, all Swiss public bodies must disclose their open-source software code.

The only exceptions are when third-party rights or security concerns are at stake. This “public money, public code” approach aims to enhance transparency, security, and operational efficiency within government operations. Switzerland aims to boost public trust and enhance digital infrastructure by making software source codes available.

The journey to this groundbreaking legislation was not without challenges. The push for open-source government software began in 2011 with the Swiss Federal Supreme Court’s release of Open Justitia. Despite these obstacles, the EMBAG was ultimately passed, reflecting a decisive victory for advocates of this kind of software.

The EMBAG mandates the release of OSS by the Swiss government and its contractors. It also ensures the code is distributed under an open-source license, except for third-party rights or security concerns.
