<p>The lawsuit between <a href="https://www.thecoinrepublic.com/2024/07/16/court-pushes-coinbase-to-refocus-subpoena-on-sec-chair/">Coinbase</a> and the US Securities and Exchange Commission (SEC) continues. Coinbase is asking for information on numerous internal and external SEC communications.</p> 
<p>Coinbase also seeks these documents to understand how the SEC regulates digital assets through the specific case. The SEC has opposed the request, saying it is general and irrelevant to the case.</p> 
<h2 class="wp-block-heading" id="h-sec-challenges-coinbase-s-extensive-document-request"><strong>SEC Challenges Coinbase’s Extensive Document Request</strong></h2> 
<p>On August 5, the <a href="https://assets.ctfassets.net/sygt3q11s4a9/4FEwh9K91ny7ale8HP3Nvz/71b11df241a5e1dccda6b119f5cb1ed2/SEC_v._Coinbase__Plaintiff-s_Memorandum_of_Law_in_Opposition_to_Defendants-_Motion_to_Compel_Discovery.pdf">SEC filed</a> a motion to strike Coinbase’s document request, which it termed overbroad and irrelevant. The SEC claimed that Coinbase’s request for nearly three million documents was excessive. The commission has already submitted more than 240 thousand documents and is now checking 117 thousand more.</p> 
<p>Also, the SEC argues that these additional documents are unrelated to the critical issues of the case. The agency has contended that the requested records are irrelevant to the <a href="https://www.thecoinrepublic.com/2024/07/31/secs-stance-on-solana-remains-ambiguous-how-will-sol-be-impacted/">Howey test</a> or the defense of fair notice. The SEC focuses on the practicality of generating such a large number of documents to meet the demands of the trial.</p> 
<h2 class="wp-block-heading" id="h-coinbase-demands-greater-sec-transparency"><strong>Coinbase Demands Greater SEC Transparency</strong></h2> 
<p>Coinbase’s Chief Legal Officer <a href="https://www.thecoinrepublic.com/2024/05/07/sec-decided-to-deploy-decision-on-spot-ethereum-etf-is-regulatory-hesitating/">Paul Grewal</a> has come in to support the request for more documents, stating that it will help provide more transparency. According to Grewal, these documents will depict the lack of coherence in the SEC’s regulation of digital assets. He argues that since the SEC relies on enforcement to make rules, everyone affected and the public should be provided with details.</p>

<p>Grewal used social media to stress the need to have these documents. He said there must be a level playing field, so the regulator should be more transparent. Coinbase also stated that the SEC owes its stakeholders, that is, those it regulates, a certain level of transparency.</p> 
<h2 class="wp-block-heading" id="h-legal-battle-deepens-between-sec-and-coinbase"><strong>Legal Battle Deepens Between SEC and Coinbase</strong></h2> 
<p>The SEC charged Coinbase in June 2023 with acting as an unregistered securities broker since 2019 and named 13 crypto assets as securities, intensifying the legal clash. Coinbase seeks documents to counter these allegations and the SEC’s industry regulation methods.</p> 
<p>The SEC is still not yielding to Coinbase’s demands by remaining fixated on the fact that the materials sought are unnecessary. The commission has also noted that it has submitted large volumes of material. This is evidenced by the SEC’s motion, highlighting that Coinbase’s demands are egregious.</p> 
<h2 class="wp-block-heading" id="h-sec-claims-document-demand-stretches-limits"><strong>SEC Claims Document Demand Stretches Limits</strong></h2> 
<p>The SEC stated that by meeting Coinbase’s document request, the agency would be stretched to the limit. The commission says that the searching, producing or logging three million documents is grossly unnecessary for this case. This excessive workload is another crucial factor that the SEC used in the motion to prevent Coinbase’s application.</p> 
<p>They argue that these documents are very important in identifying such gaps in regulation. Grewal claims that justice can be served only through the disclosure of information in a legal system. The conflict is between the regulatory power and the rights of the subjects of regulation, which is also a common problem.</p>
