A U.S. federal judge has dismissed GreenUnited's motion to dismiss, allowing the Securities and Exchange Commission's (<a href="https://ultramining.com/news/en/bitcoin-mining-reshaping-landscape-amid-global-interest-surge/" rel="noopener noreferrer nofollow">SEC</a>) lawsuit against the firm to proceed. The SEC accuses GreenUnited of defrauding investors of $18 million through the sale of "GreenBoxes" <a href="https://ultramining.com/news/en/immersion-cooling-transforms-chinas-crypto-mining-landscape/" rel="noopener noreferrer nofollow">mining equipment</a>.
The court's decision has sparked discussions on social media about the potential classification of cryptocurrency mining equipment sales as securities. However, legal experts assert there is no cause for alarm if the equipment is sold with the understanding that the end user will conduct the mining.
Attorney Ishmael Green of DiazReus emphasized that in GreenUnited's case, the company controlled and operated the system, which became the crux of the issue.
