A Texas court&nbsp;<a style="text-decoration:none" href="https://www.courtlistener.com/docket/68471897/57/consensys-software-inc-v-gensler/">dismissed</a> Consensys’ lawsuit against the Securities and Exchange Commission (SEC).&nbsp;
The decision, announced on September 19, 2024, follows the firm’s legal action aimed at challenging the SEC’s classification of Ethereum as a security.

Consensys&nbsp;<a style="text-decoration:none" href="https://consensys.io/crypto-regulations/defend-ethereum">filed its lawsuit</a> in April after receiving a Wells notice from the SEC. This notice indicated the SEC’s intention to recommend enforcement action against the company concerning its popular Ethereum wallet, MetaMask.&nbsp;

The firm contended that the SEC's actions constituted regulatory overreach and sought to defend the Ethereum ecosystem from what it perceived as unwarranted scrutiny. In its filing, Consensys argued that Ether, the native cryptocurrency of the Ethereum network, should not be classified as a security.&nbsp;

The lawsuit reportedly aimed to mitigate risk and address potential legal consequences stemming from the SEC’s inquiry into MetaMask's Swaps and Staking features.
<h2 dir="ltr" id="span-span-court-ruling-span-span">Court Ruling</h2>
Judge Reed O’Connor of the Northern District of Texas dismissed the case on procedural grounds. He stated that the court could not consider the claim because the SEC had not yet taken definitive action that warranted judicial review.&nbsp;

O’Connor noted:

A spokesperson for Consensys expressed disappointment that the court did not examine the merits of the claims against the SEC, according to Decrypt.

Following the lawsuit, the SEC dropped its investigation into Ethereum 2.0, a development viewed as a victory for Consensys and the Ethereum ecosystem.&nbsp;

Meanwhile, Consensys has announced plans to file a motion to dismiss the SEC's lawsuit, signaling that it intends to vigorously contest the allegations.
