<p>The European Parliament has underscored the imperative of ensuring that AI systems used within the EU embody safety, transparency, traceability, non-discrimination, and environmental friendliness. The emphasis is on human stewardship over automation, forming a bulwark against potentially harmful outcomes. The Parliament is also committed to carving out a technology-neutral, uniform definition of AI, thereby providing a flexible framework adaptable to future AI systems.</p>

<p>The AI Act introduces a stratified risk-based approach, devising distinct rules based on the potential risk levels posed by AI systems.</p>

<p>AI systems deemed to pose an unacceptable risk to individuals will face prohibition. This includes systems engaging in cognitive behavioural manipulation, social scoring, or real-time and remote biometric identification systems such as facial recognition. However, exceptions may be permitted, subject to stringent court approval processes.</p>

<p>AI systems that infringe on safety or fundamental rights are categorised as high risk. These include AI systems used in products that fall under the EU’s product safety legislation and those used in eight specific areas. High-risk AI systems will be subject to rigorous scrutiny prior to market entry and throughout their lifecycle. Additionally, they will be required to register in an EU database.</p>

<p>Generative AI systems, akin to ChatGPT, will need to meet rigorous transparency requirements. These stipulations include a disclosure obligation stating that the content was AI-generated, design mandates to prevent the generation of illicit content, and the requirement to publish summaries of copyrighted data used in training the AI model.</p>

User interaction with these systems should be premised on informed decision-making, necessitating that users are apprised when they are interacting with AI, including AI systems that generate or manipulate digital content.</p>

<p>With the EU Parliament poised to finalize its negotiating position in June 2023, engaging discussions with EU countries in the Council on the Act&#8217;s final version is imminent.
